BOOKING AND CONTRACTING PROCEDURE

The environment in which you will be part is formed of a maximum of tolerance and integration with the students, where above all and everyone, there is the respect for people, their beliefs, ideas and traditions.
In our residences we encourage socialization and learning from each other, to make the fact of living together something easy and healthy to allow us to help each other as community.
In the following Terms and Conditions (hereinafter “T&C”) you will find our legal conditions governing the contracting of our services. It is important for you to read and understand them as, making a booking or contracting our services you agree to be bound by these T&C.
We remind you that, to book any room or contract any of the services offered through our Website, you must be of legal age and provide all the information requested during the registration process and subsequently, as instructed, in order to access to our residences.
In case you were underage, during the registration process, we will request some information of your legal guardian and we will contact him/her to finalize the contracting of the services and rooms offered and to guarantee that you have the authorization to stay in one of our residences.
Notwithstanding the foregoing, the resident must be over 16 years old on the start date of the stay. Otherwise, the agreement will be null and void and of no force and effect.
If you are interested in booking a room in our residences or accommodations, you will have to create an account and be registered in our Website to complete the steps we indicate hereunder.
Once you have provided us with certain necessary information about the residence or the accommodation you are interested in, in order to indicate the availability, you will need to create a profile and be registered in order to be able to make a booking.
If there is no availability, a message will appear informing you of this situation, inviting you to select other dates, room type and/or residence or accommodation.
Once you have consulted our residences and accommodation, the rooms, their features, availability and, finally, you have created a profile, you will be able to book a room and contract any additional services that may be available in each one of them. The services offered and described on the Website will contain specific conditions such as the price and/or cancellation, and other issues considered relevant to your booking (“Particular Conditions”) and will be specific and binding.
Therefore, by accepting them, we are expressly regulating your rights and obligations, acknowledging and declaring that you have read each and every one of the legal texts mentioned above.
Once you have completed all the necessary information for the booking of the room and, if applicable, other additional services, the corresponding agreement shall be considered signed by the acceptance of the relevant terms and conditions.
To complete the booking process, and depending on the length of the stay, you will have to pay the amounts indicated in the periods stipulated in each case, as described below, from the signature of the agreement. Once completed the booking process and the signature of the agreement, we will send you an e-mail informing you that the request has been registered and the room booked. In case the payment of the appropriate amounts had not been made within two (2) days from the signature of the agreement (48 hours), neither the booking nor the signed agreement will have any validity between the parties.
Subsequently and once the booking has been confirmed, the next step will be to finalize the contracting of booked room that binds you with the residence or accommodation for the selected period of time by making the payments of the remaining amounts within the indicated time period and which must be made, at the latest, within the period indicated in the agreement and, in any case, prior to check-in.
MODIFICATION OR CANCELLATION OF THE BOOKING
In case you would like to modify or cancel the booking of the room, or the services contracted, please see our Cancellation Policy below.
The methods of payment accepted are:
- SEPA zone
- Payments available through the Flywire platform.
- Direct debit payment.
*The SEPA area consists of thirty-six countries: the members of the European Economic Area (comprising the twenty-seven states of the European Union plus Liechtenstein, Iceland and Norway) and Andorra, Monaco, San Marino, Switzerland, United Kingdom and Vatican City State).
- Other areas
The means of payment accepted for the formalisation of reservations will be those available on the Flywire platform, which may vary depending on the country you are in.

Student Residence Livensa Living
BOOKINGS AND CANCELLATION POLICY – STUDENT RESIDENCE
This Booking Policy shall apply to those Agreements to which the payment concepts set out herein apply.
To book a room or a bed in a Livensa Living Residence for Students (“Livensa”), you will have to pay, through our online booking system, the Booking Fee, the Housing Fee and the Deposit.
The Booking Fee will be paid at the time of formalising the booking and the signature of the agreement.
The Deposit and the first month’s Housing fee must be paid at least 30 days before the start date of the Agreement.
Depending on the duration of your stay, or in case the start date of the Agreement is equal to or less than 30 days from the booking date, we may ask you at that time to also to make the full payment of the stay or the first month’s Housing fee along with the Deposit.
Cancellation policy AY
- Prior to the start date of the Agreement
You may request the cancellation of your contract if:
(i) Your cancellation request is made within a maximum of 14 days from the signature date to the Start Date of the Agreement. If the period between the date of your booking and the Start Date of the contract is less than 14 days, the cancellation for this reason will be only valid for the days remaining between the signing and the commencement of the contract (“the right of withdrawal”).
To exercise the right of withdrawal, you may complete Annex II of the Agreement, or any other form, as an unequivocal declaration of your wish to withdraw from the Agreement, accompanied by a copy of your ID card or passport, and send it by e-mail to [email protected].
(ii) You were not admitted to the university/educational institution in the province for which you made the booking. In this case, you must provide proof of enrolment in a different province.
(iii) your visa application, for the period corresponding to your booking, has been refused by the Spanish/Portuguese authorities. The visa refusal document will be requested as proof.
In all the above cases, the amounts already paid will be refunded.
If you are not in any of the above situations, you may still request the cancellation of the Agreement if:
- You find a person as a replacement, under the same conditions and type of contract, until at least the End Date of the Agreement.
This person shall not have signed a Student Housing Agreement during the previous academic year, nor be in the process of negotiation or having signed a Student Housing Agreement for the current academic year.
- If with respect to the Agreed Period, you pay 50% of the Housing Fee as compensation for the damage caused.
In any case, the penalty shall not be less than one (1) month nor more than three (3) months of the Housing Fee that was contracted.
- After the start date of the Agreement and before the agreed period has expired
You may request the cancellation of your contract if:
(i) You find a replacement until at least the End Date of the Agreement.
The person replacing you will have to meet the same requirements mentioned above, and also have the student status for the duration of stay (applicable in some establishments managed by Livensa) and be of the same gender as you in the case of a bed in a shared room. To request the cancellation of the contract, you will have to inform us in writing by sending an e-mail to the address of your residence indicated in the Agreement, and follow the procedure indicated for that case.
(ii) You may request the unilateral cancellation of the Agreement, before the expiry of the agreed period, if with respect to the time required to complete the Agreed Period, you pay 50% of the remaining amount of the Agreement, considering that:
- You will have to pay in full the month which you leave the Residence, and
- The penalty will be calculated considering the period remaining to complete the Agreement (End Date), excluding the month in which you leave the Residence.
In any case, this penalty shall not be less than one (1) month nor more than three (3) months of the Housing Fee that was contracted.
To request the cancellation of the contract, you will have to inform us in writing by sending an e-mail to the address of your residence indicated in the contract.
Cancellation of your booking by Livensa
Our terms and conditions include the need for the Resident to sign the Agreement and accepts this T&C, concluding the booking by paying the Booking Fee within forty-eight (48) hours from the date of signing the Agreement in order for the contract to become effective.
Therefore, if you do not make the payment within this period, Livensa may consider the booking process as not completed and, therefore, the booking of the requested Room or bed cannot be guaranteed.
In case you make a booking for a Double/Twin/Duplo room, it will only be valid if the resident is of the same gender as the indicated in the chosen room.
Livensa Living Accommodation
The Client can make a booking through our website, through the telephone booking system or through any other official platform in which Livensa Living Studios offers that possibility.
When making a booking, the Client must provide the identification data and make the payment of the corresponding amount depending on the type of booking, in accordance with the means of payment specified in this same document.
The amount to be paid as a booking will vary depending on the duration of the contracted stay. For bookings for a period equal to or less than 30 days, it will be required the payment in advance of the entire contracted stay when making the booking. For bookings for periods longer than 30 days, it will be required an advance payment of:
- If the check-in date is between the 1st and the 14th day of the month, an advance payment of the amount corresponding to the days of occupation of the calendar month to which the booking refers;
- If the check-in date is between the 15th and the last day of the month, or before, an advance payment of the amount corresponding to the days of occupation of the calendar month to which the booking refers plus the amount corresponding to the following month.
Once the booking has been made and the corresponding amount has been paid in each case, within a maximum period of 24 hours, Livensa Living Studios will send the Client an email confirming the booking (Booking Confirmation Document). A booking requests will not be considered accepted until the Client has received the Booking Confirmation Document.
In case of starting the booking process (pre-booking) and not making the payment of the corresponding amount within a period of 48 hours, the pre-booking will be without effect and will be understood as not made.
Cancellations must be communicated by sending an e-mail to [email protected] indicating the booking number, date of entry according to the booking and relevant data of the person who made the booking:
The cancellation of a booking will result in the application of the following penalties:
Bookings of less than 30 days can be cancelled without cost with more than 7 calendar days before the start of the booking.
For bookings longer than 30 days, or in the case of bookings for a shorter period but canceled less than 7 days in advance, the following penalties will apply:
- If the cancellation is notified more than 30 days in advance: 5% of the total amount of the booking.
- If the cancellation is notified between 30 and 15 days in advance: 40% of the total amount of the booking.
- If the cancellation is notified between 14 and 7 days in advance: 60% of the total amount of the booking.
- If the cancellation is notified less than 7 days in advance, the total amount of the reservation will be forfeited.
Special or long stay rates may have special cancellation conditions, which will be detailed at the time of booking.
In the Livensa Living Studios San Sebastian/Donostia and Livensa Living Studios Valencia Marina Real establishments, no cancellation penalties will be applied if a new client agrees to subrogate said booking, assuming the period and conditions of the booking to be cancelled. It will be understood that the subrogation is formalized when the new client accepts the terms and conditions of the booking.
In the case of a student rate booking, failure to obtain a place in a university in the province in which the establishment is located or the denial of a student visa may justify the cancellation of the booking without penalty, before the start date of the contract, provided that it is duly accredited by means of the documents indicated in each case.
It will be understood that the cancellation has been communicated when the email or notification has been sent before 12:00 noon on the day of reference. Any email or notification sent after 12.00 a.m. on the day of reference shall be deemed to have been communicated on the following day.
Failure to arrive at the accommodation without notice or cancellation will result in the loss of the total amount paid for the booking.
All bookings are subject to availability. Livensa Living Studios reserves the right to reject a booking at any time, cancel it or not accept it, in the event that the payment information provided is not valid or if the security systems indicate that the reservation is anomalous or there is a risk that it is fraudulent.
In case you make a booking for a Double/Twin/Duplo room, it will only be valid if the resident is of the same gender as the indicated in the chosen room.
Livensa Living "Livensa Traveller" Promotion
Go on holiday and stay at any Livensa Living establishment in Spain or Portugal – and, if you like, bring a friend with!
As a Livensa Living resident, we’re offering you and a friend the opportunity to book a Livensa Living accommodation or at special rates for up to 8 weeks per year, with a minimum stay of 3 nights.
1. Validity period
The promotion is available from 1st June 2022.
Residents staying with us for the 22/23 or 23/24 Academic Year, provided they hold a current contract of 3 months or more, can enjoy the special Livensa Traveller promotion until 30th August 2024.
2. Promotional rate
You can stay at Livensa Living accommodation in Spain or Portugal on a room-only basis (meals and other extras are not included):
• The daily rate for a standard single room, subject to availability: €35 including VAT (linen included, as well as weekly cleaning for stays of more than 8 days)
• This rate may not be available on specific dates or periods.
3. Conditions of the Livensa Traveller offer
• You must be a resident for academic year 22/23 or 23/24, with a confirmed booking of 3 months or more.
• You must book for a minimum stay of 3 nights and a maximum of 21 consecutive nights per stay.
• The resident may extend the offer to a friend; the friend need not be a Livensa Living resident. The friend must book a standard single room in the same residence and for the same dates as the resident.
• Both the resident and the friend must be of legal age.
• The booking must be paid in full on the date Livensa Living issues the confirmation.
• Along with the amount due for the stay, the resident and the friend must each pay a deposit of €100 per booking. The residence will keep this deposit as a guarantee under the same terms as in the Housing Contract for academic year or semester bookings.
• The resident must be up to date with payments at their main residence in order to qualify for the promotion.
• The resident and the friend will each individually sign a Housing Contract and its corresponding Code of Conduct.
• The resident and the friend shall not be entitled to receive visitors during their stay.
• At the time of booking, the resident and the friend must prove their student status by showing a student ID or confirmation of enrolment from their educational institution.
• It is possible to book at more than one accommodation site provided the stipulated time limits for the duration and period of stay are respected.
• The offer is not valid for bookings made at the resident’s main residence.
4. How to book your Livensa Traveller stay:
• Interested parties should book their stay and, if applicable, that of their friend by sending an email to the front desk of the residence where they are currently staying, including:
o Name and ID number of resident and (if applicable) friend
o Destination residence
o Booking dates
o Attach documents certifying student status
• Livensa Living will reply to the resident confirming the availability of the booking, providing arrangements for making the payment and signing the accommodation contract.
• Bookings may only be made between 7 and 30 days prior to the requested arrival date.
Rooms offered through this promotion are subject to the availability of rooms at each residence. Bookings will be handled in the order in which they are received.
6. Changes to the terms and conditions
This promotion is offered by Livensa Living. The terms of participation will be revised and are subject to change at the end of each academic year or period of validity.
7. Data protection
The Data Controller will process the data in a lawful, fair and transparent manner for the following purposes:
a) To manage the booking of the Data Subject in this promotion.
b) To communicate the relevant data to the leasing entities at the residences which the Data Subject wishes to visit, according to the terms and conditions outlined here.
c) Compliance with the legal obligations to which the Data Controller is subject as a result of this promotion.
The legitimate basis for data processing following from purposes a) and b) is the fulfilment of the contractual relationship maintained between the Controller and the Data Subject through the acceptance of these terms and conditions. For this reason, the Data Subject’s data must be processed in order to carry out the established purposes; without it, it would not be possible to achieve them. The legitimate basis for the processing of the Data Subject’s data for the purpose c) comes from the Controller’s obligation to comply with the applicable legal provisions.
Any resident participating in this promotion affirms that they are authorised by their friend to provide the friend’s personal data. Likewise, they affirm that, if they directly provide their friend’s personal data to participate in the promotion, they have provided said friend with the content of this document and, in particular, the content in this data protection clause.
In addition to sending the Data Subjects’ data to the destination residences, as required to participate in the promotion, the personal data provided by the Data Subjects may be communicated to governmental entities when required by the same or in compliance with any obligation established in current legislation in force at any time, as well as to the leasing entities of the Data Subjects’ destination residences to manage the promotion.
The personal data provided will be retained for as long as the contractual relationship with the Data Subject is in force. Once this relationship is terminated, where appropriate, it may be retained for the time required by applicable law and until the expiration of any liabilities arising from the same.
The Data Subject may exercise their rights of access, rectification, deletion, opposition, limitation and data portability by sending an email to the Data Protection Delegate: [email protected] or by sending a letter via post to: C/ Poeta Joan Maragall 1, 7º 28120 Madrid, under the terms established in the current regulations. Likewise, if the Data Subject believes that their rights under applicable data protection regulations have been violated, they may file a claim with the Spanish Data Protection Agency.
Sending a request to participate in the promotion implies the express acceptance of all of these rules of participation in the “Livensa Traveller” promotion.
8. Livensa Living’s decisions regarding all matters related to this promotion and final incentive will be definite.
9. Participants in this promotion are deemed to accept all terms and conditions of this promotion.
