TERMS AND CONDITIONS
BOOKING AND CONTRACTING PROCEDURE
If you are interested in booking a room in our residences or accommodation, you will have to create an account and be registered in our Website to complete the steps we indicate hereunder.
First of all, and once you have provided us with certain necessary information regarding the availability of the selected residence or accommodation, you need to create a profile and be registered to make a booking.
If there were no availability, a message informing you of that situation will appear inviting you to select another period, room type and/or residence or accommodation.
Once you have consulted how our residences or accommodation and rooms are, their features, their availability and, finally, you would have created a profile, you are able to book a room and contract any additional services that may be available in each residence. The services offered and described on the Website will contain specific conditions such as the price and/or cancellation, and other issues considered relevant by Alumni in order to your booking (“Particular Conditions”) and will specific and binding to you.
That is why, by accepting them, your rights and obligations are expressly regulated, acknowledging and declaring that you have read each and every one of the legal texts mentioned above.
Once completed all the information requested for the booking procedure, you will have to sign the agreement.
To complete the booking process, and depending on the length of the stay, you will have to pay the amounts indicated in the periods stipulated in each case, as described below, from the signature of the agreement. Once completed the booking process and the signature of the agreement, you will be sent an email informing you that the request has been registered and the room booked. In case the payment of the appropriate amounts had not been made within two (2) days from the signature of the agreement (48 hours), neither the booking nor the signed agreement will be valid between the parties.
Subsequently and once the booking is confirmed, the next step will be to formalize the booking done that binds you with the residence or accommodation during the period of time selected making the payments of the remaining amounts within the indicated time period that must be done, at the very latest, at the time indicated into the agreement and prior to check-in. Otherwise, the agreement will not be effective.
MODIFY OR CANCEL THE BOOKING
In case you would like to modify or cancel the booking of the room or the services contracted, please, visit the Cancellation Policy below.
METHODS OF PAYMENT
The methods of payment accepted will be those indicated on the Website, whereas we reserve the right to modify and include different options as an available method of payment.
BOOKINGS AND CANCELLATIONS POLICY
STUDENT RESIDENCE LIVENSA LIVING
This Booking Policy shall apply, where applicable, to those Contracts to which the payment concepts set out herein apply.
To book a room or a bed in a Livensa Living Student Residence (“Livensa”), you will have to pay, through our online booking system, the Booking Fee, the Accommodation Fee and the Deposit.
The amount of the Booking Fee will be paid at the time of formalising the reservation and electronic signature of the contract.
The Deposit and the first month’s accommodation must be paid at least 30 days before the start date of the contract.
Depending on the duration of your stay, or in case the start date of the contract is equal to or less than 30 days from the booking date, we may ask you at that time to also to make the full payment of the stay or the first month’s accommodation and the Deposit.
Cancellation policy AY 2022-23
- Prior to the start date of the contract
You may request the cancellation of your contract if:
(i) Your cancellation request is made within a maximum of 14 days from the date of your online booking (“the right of withdrawal”). If the period between the date of your booking and the date of commencement of the contract is less than 14 days, the cancellation is only valid until the date of commencement of the contract.
To exercise the right of withdrawal, the Resident may complete Annex II of the contract, or any other form, as an unequivocal declaration of his/her wish to withdraw from the Contract, accompanied by a copy of his/her national identity card or passport, and send by e-mail to [email protected], and follow the procedure indicated for that case.
(ii) You were not admitted to the university/educational institution in the city for which you made the reservation. In this case, you must provide proof of enrolment in a different city or, failing that, documentary evidence of the reason for not having enrolled.
(iii) your visa application, for the period corresponding to your booking, has been refused by the Spanish/Portuguese authorities. The visa refusal document will be requested as proof.
In all the above cases, the amounts already paid will be refunded.
- After the start date of the contract and before the agreed period has expired
You may request the cancellation of your contract if:
(i) you find a replacement until at least the end date of your contract.
The person replacing you will have to meet the same requirements as you: have student status for the duration of their stay (applicable in some establishments managed by Livensa) and be of the same gender as you in the case of a bed in a shared room. To request the cancellation of the contract, you will have to inform us in writing by sending an e-mail to the address of your residence indicated in the contract.
(ii) You may request the unilateral cancellation of your contract, before the expiry of the agreed period, if you pay an amount equal to 50% of the amount of the contracted stay, as compensation for the damage caused. This amount is the equivalent of the remaining amount until the end of the Contract. In any case, this penalty shall not be less than one (1) month nor more than three (3) months of the cost of the contracted stay.
This amount shall be calculated taking into account the exact days remaining from the Resident’s request for early termination of the contract until the expiry of the Agreed Period.
In the event that the Resident wishes to unilaterally terminate in advance a contract of less than one hundred and fifty (150) days (short or very short stay), the amounts already paid in advance will not be refundable.
To request the cancellation of the contract, you will have to inform us in writing by sending an e-mail to the address of your residence indicated in the contract.
Cancellation of your reservation “Pair a Dice”.
For bookings made under the “Pair a Dice” promotion, if one of the two persons wishes to cancel his/her reservation for the TWIN room before the contract start date, the person who wishes to keep his/her reservation may do so:
1) move into a regular TWIN room, sharing a room with a resident assigned by Livensa, or Modify your reservation and request a simple Studio.
In both cases, you will have to pay the difference between the new fare and the “Pair a Dice” fare.
Cancellation of your booking by Livensa
Our terms and conditions include the need for the Resident to sign the contract online, by electronic signature, and to finalise the booking by paying the Tuition Fee within forty-eight (48) hours from the date of signing the contract in order for it to become effective.
Therefore, if you do not make the payment within this period, Livensa may consider the reservation process as not completed and, therefore, the reservation of the requested Room or bed cannot be guaranteed.
LIVENSA LIVING ACCOMMODATION
This Cancellation Policy shall apply to all bookings made through the Livensa Living Accommodation booking system and shall be applicable depending on the type of rate chosen in each case.
Cancellations must be communicated by sending an e-mail to [email protected] as an unequivocal declaration of your wish to cancel the contract, accompanied by a copy of your national identity card or passport, as well as an indication of the identification data provided when making the reservation: Name and surname, e-mail, reservation number, date of arrival and departure.
You should be aware that by booking with Livensa Living, you are entering into a contract with us, and you are responsible for the full payment of the amounts due for the period booked.
In the event of cancellation of your booking, the following cancellation policies apply:
(i) No refunds will be made, and the customer is obliged to pay the full amount of the booked stay, except in the following cases:
(ii) For tariff offers applicable to bookings of more than ninety days, in the event of refusal by the Spanish authorities of the visa required for the period corresponding to the booking. In this case, the amounts already paid shall be reimbursed. The visa refusal document shall be requested as proof.
(iii) In the event that you wish to terminate your stay, once you have checked-in prior to the final date of your booking, the full amount of the stay will be charged and no refund will be made, except in the following case.
However, for tariff offers applicable to stays of five (5) months or more, in the event that you wish to end your stay before the expiry of the agreed period, a penalty equivalent to 50% of the amount of the contracted stay will be charged. In any case, this penalty shall not be less than one (1) month nor more than three (3) months of the cost of the contracted stay in accordance with the applicable rate.
All bookings are subject to availability. Livensa Living reserves the right at any time to refuse, cancel or not accept a booking if the payment information provided is invalid or if security systems indicate that the booking is anomalous or at risk of fraudulent. If payment is not made within 48 hours of acceptance of the terms and conditions, Livensa Living may automatically cancel your booking without notice.
